These Terms of Use ("Terms") govern your access to and use of Favico - Free Online Tools for Favicon, Image & SVG ("Favico", "we", "us", or "our") and the related website, web application, and tools (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.
1. Eligibility
You must be able to form a binding contract in your jurisdiction to use the Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Service Description
Favico provides online utilities for favicon generation, image editing, and SVG conversion. Many operations are designed to run locally in your browser. Some features may require network requests (for example, retrieving a website’s favicon or other resources when you provide a URL).
3. No Accounts
The Service does not require you to create an account. You are responsible for maintaining the security of your own devices, browsers, and any data you choose to process.
4. Acceptable Use
You agree not to misuse the Service. In particular, you agree not to:
- Break the law or encourage unlawful activity
- Violate others’ rights, including intellectual property, privacy, or publicity rights
- Upload or generate harmful content, including malware, phishing content, or anything intended to disrupt systems or networks
- Interfere with the Service, including attempting to bypass rate limits, security, or access controls
- Reverse engineer or attempt to discover source code except where permitted by applicable law
- Scrape the Service at scale or use automated means in a way that materially degrades performance
5. Your Content
You may provide content to the Service (for example, images, text, or URLs) ("User Content"). You retain ownership of your User Content. You represent and warrant that you have the rights necessary to use and submit the User Content and that doing so does not violate law or third-party rights.
To the extent the Service processes User Content (including local processing in your browser and any network requests initiated by you), you grant us a limited license to process such content solely to operate and provide the Service.
6. Feedback
If you provide suggestions, ideas, or feedback about the Service ("Feedback"), you grant us a perpetual, irrevocable, worldwide, royalty-free license to use and incorporate the Feedback into the Service without any obligation to you.
7. Intellectual Property
The Service and its associated content (excluding User Content) are owned by Favico and its licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal or internal business purposes in accordance with these Terms.
8. Third-Party Services and Links
The Service may link to third-party websites or services. We do not control third parties and are not responsible for their content, policies, or practices. Your interactions with third parties are solely between you and the third party.
9. Copyright Complaints
If you believe content on the Service infringes your copyright, please contact us with sufficient information to identify the material and your rights. We may remove or restrict access to content as required by applicable law.
10. Disclaimers
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, ICONFAV DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or secure, or that defects will be corrected. You are responsible for verifying outputs before relying on them in production.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL ICONFAV BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ICONFAV’S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID (IF ANY) TO USE THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
12. Indemnification
You agree to defend, indemnify, and hold harmless Favico and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Service or your violation of these Terms.
13. Suspension and Termination
We may suspend or terminate access to the Service at any time if we reasonably believe you have violated these Terms, pose a security risk, or for other lawful reasons. You may stop using the Service at any time.
14. Changes to the Service or Terms
We may modify the Service or these Terms from time to time. If we update these Terms, we will post the updated version on this page and update the effective date. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
15. Severability
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
16. Entire Agreement
These Terms constitute the entire agreement between you and Favico regarding the Service and supersede any prior or contemporaneous understandings on the subject.
17. Governing Law
These Terms are governed by applicable laws, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service must be brought in a court of competent jurisdiction, unless applicable law provides otherwise.
